Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Poker Notes Live ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of the App

The App is a personal note-taking tool that allows you to record private notes, photos, and observations about individuals you encounter during live poker play, for your own personal use. Your notes, photos, and other content are stored on cloud servers used by Host Innovations Inc. to provide the App and make Your Content available to you through the App.

3. Eligibility

You must be at least 18 years old to use the App.

4. Your Responsibilities

You are solely responsible for:

  • Ensuring your use of the App complies with all applicable laws in your jurisdiction, including any laws related to photography, recording, privacy, and the collection of personal or biometric information about other individuals.
  • Complying with the rules, policies, and code of conduct of any casino, card room, or venue where you use the App.
  • The accuracy and content of any notes, photos, or information you enter about other individuals.
  • Obtaining any consent required by law before photographing or recording information about another person in your jurisdiction.

The App is a tool. Host Innovations Inc. does not routinely monitor or review the content you create with it, but may access or process content when reasonably necessary to operate, secure, maintain, or support the App, enforce these Terms, or comply with applicable law. Host Innovations Inc. is not responsible for how you use the App.

5. Prohibited Uses

You agree not to use the App to:

  • Violate any applicable law, including harassment, stalking, or privacy laws.
  • Store or distribute content that is unlawful, threatening, or violates the rights of others.
  • Attempt to reverse-engineer, resell, or redistribute the App without authorization.

6. Your Content

You retain ownership of the notes, photos, and content you create within the App ("Your Content"). You grant Host Innovations Inc. a limited, non-exclusive right to host, store, reproduce, transmit, and process Your Content solely as reasonably necessary to operate, provide, secure, maintain, and support the App, enforce these Terms, and comply with applicable law.

Your Content is stored on cloud servers used by Host Innovations Inc. and may also be included in system backups. Although we take reasonable measures to protect stored data, no storage system can guarantee that data will never be lost, corrupted, accessed without authorization, or become unavailable. You are responsible for maintaining copies of any information you consider critical.

7. Privacy

Please review our Privacy Policy, which describes what information the App collects, how it is stored, and how it is used.

8. Subscriptions and Payment

Subscription and billing terms will be provided at the time of purchase and are subject to applicable consumer protection laws.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HOST INNOVATIONS INC. DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DATA WILL NOT BE LOST.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOST INNOVATIONS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY LEGAL CLAIMS ARISING FROM YOUR USE OF THE APP TO DOCUMENT OTHER INDIVIDUALS.

11. Indemnification

You agree to indemnify and hold harmless Host Innovations Inc. from any claims, damages, or expenses (including legal fees) arising from your use of the App, including any claims brought by third parties whose information you have stored using the App.

12. Termination

Host Innovations Inc. may suspend or terminate your access to the App at any time for violation of these Terms.

13. Changes to These Terms

Host Innovations Inc. may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.
